Plaintiffs argue the law is unconstitutional
In Camden on Friday, a federal judge heard arguments in a case to overturn a state law restricting the concealed carry of firearms. Gun rights advocates are challenging the law Gov. Phil Murphy signed in December banning guns in many so-called sensitive places. The law was passed in response to a U.S. Supreme Court ruling that made it easier for people to get a permit to carry a concealed firearm.

Learn Moreabout PBS online sponsorshiptoday in Camden a federal judge heard arguments in a case to overturn a state law restricting concealed carry of firearms gun rights Advocates are challenging the law Governor Murphy signed in December banning guns and dozens of so-called sensitive places in New Jersey the law was passed in response to a Supreme Court ruling that made it easier for people to get a permit to carry a concealed firearm but plaintiffs argued today that the state law is unconstitutional and want the judge to keep it from being enforced senior correspondent Joanna gagus was in the courtroom today Joanna what arguments did you hear well Raven we heard argument today over the constitutionality of New Jersey's recent concealed carry gun law the plaintiff's attorneys arguing in federal court today that the United States Supreme Court in the Bruin case broadly permits firearms in places where people gather and that New Jersey's restrictions are unconstitutional and violate the Second Amendment now the state argued that the Bruin case allows for interpretation of newly defined spaces and that simply didn't exist in the 1700s when original gun laws were written those were much of the Crux of today's arguments it's been from the beginning it's what it remains today one of the plaintiff's attorneys Daniel schmutter arguing that New Jersey's law creating an exhaustive list of sensitive places where permitted gun owners are restricted from carrying is in violation of the earliest gun carrying restrictions okay as Runners aware of course to be placed that's governance and it's not it's actually narrower within government functions because as the runner knows the state claims that libraries and museums and all that stuff is government functions it's the function of governance David Jensen also a plaintiff's attorney furthering that argument by referring to laws written in the 1700s when the country was ruled by a king no person shall come before the king's justices or other of the king's ministers doing their office with force and arms nor Bring No Force in a free of the Peace nor go nor ride armed by night nor by day in fears markets nor in the presence of the justices or other ministers as we stand here there's still nothing in the record to support anything other than legislatures courthouses and polling places the state argued that this limited interpretation ignores a key piece of that 18th century law that the plaintiffs referenced what he wants to read out of that very sentence is where it also says one cannot go ride by night or day in Ferris and Marcus and so you can't have it both ways you can't rely on the Statue of Northampton for the provision of the courthouses but they didn't read out the fair Demarcus language for what is Bruin asking for is asking for historical evidence of what people understood the second amendment allowed that's the point of the historical analogy attorney Deputy solicitor general Angela Kai defending the state's inclusion of places like zoos Parks hospitals and transportation hubs that last one drawing questions from the judge about what would constitute a violation is someone is on the turnpike in the perimeter of the Newark Airport violating this restriction no your honor it has to be the airport itself the way where you're not restricted and so if you're driving on the pickup Lane of Newark Airport that's not a violation gun rights Advocate Scott box saying the states fighting a losing battle fundamentally trying to change what it means to have a carry permit in the first place by blocking carry nearly everywhere in public and so Bruin says you can't do that so it's we know where this is going they lose in the end there was no decision from the federal judge today but even she acknowledged that this case is likely to make its way all the way up to the U.S Supreme Court at the U.S District Courthouse in Camden I'm Joanna gagis back to you in the studio Raven [Music÷}
